1. Agreement to Terms

By accessing or using ModernHMS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is provided by ModernHMS ("we", "us", "our").

2. Description of Service

ModernHMS is a cloud-based hotel management system that provides property management, billing, food and beverage point of sale, inventory management, housekeeping, payroll, reporting, and booking engine functionality. The Service is provided on a subscription basis.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account. Each user account is for a single individual and may not be shared.

4. Subscription and Payment

The Service is offered under various subscription plans. Fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' advance notice.

5. Data Ownership

You retain all rights to your data. We do not claim ownership of any data you upload or create through the Service. Upon termination, you may request an export of your data within 30 days.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose, to violate any regulations, or to infringe on the rights of others. You may not attempt to gain unauthorised access to the Service or its related systems.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by law, ModernHMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

9. Termination

Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you violate these terms. Upon termination, your right to use the Service ceases immediately.

10. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated terms.
